Some parents in South Carolina – and across the country – struggle because they say they’re not being paid child support that is owed to them.
John Davis emailed us a Good Question! asking, “Why is there no way to report a person for not paying child support?”
The best way to report someone who is not paying child support is to contact the local Department of Social Services office or the local Clerk of Court’s office. In South Carolina, the clerk of court keeps record of all payments owed and received regarding child support. It will have record if a person has not paid what they owe.
From there, judicial action can be made. The clerk would need updated information on the delinquent to track down where they live and where they work. They can issue a warrant for them to appear in court and pay their dues, but if that doesn’t work then more extreme measures can be taken.
Larry McKeown, director of child support enforcement with SC DSS, said there are a few ways to retrieve money that is owed to a custodial parent.
- DSS can contact the delinquent’s employer and have them automatically withdraw money from their paycheck before the check is issued.
- DSS works with the IRS and Dept. of Revenue to intercept any taxes that may be owed to the offender.
- DSS will look for a bank account to “freeze and seize” money from.
Money retrieved from any of these methods would go towards the custodial parent.
