Jefferson man accused of having sex with girl

A 18-year-old man was arrested Tuesday after a deputy caught him having sex in a parked car with his 13-year-old girlfriend, according to a press release issued Wednesday by the Darlington County Sheriff’s Office.

Johnny D. Gainey of 15601 S.C. 151, Jefferson, is charged with second-degree criminal sexual conduct, according to the press release.

The deputy was patrolling an area near Jefferson when he saw a parked car with the suspect and girl inside, then discovered the two had been involved in sexual relations, according to the release.

“A 13-year-old cannot consent to sex with anyone in the state of South Carolina,” Darlington County Sheriff Wayne Byrd said in the press release. “The deputy did a great job following up on the call, asking questions and not just letting him go.”

Gainey remains in custody at the Darlington County Detention Center under a $15,000 surety bond.
