A federal judge has denied a motion to reconsider the release of a former Florence County Sheriff’s deputy who is indicted on federal charges he shot his mother and step-father.
In September, Kirk Truslow, defense attorney for Timothy Poole, filed a memorandum in support of his client's release before he stands trial on a 20-count federal indictment.
Poole along with Jodie Ann Poole are charged in the same indictment and each face one count of conspiracy to commit mail and wire fraud, 17 counts of mail fraud and two counts of wire fraud in connection with the deaths. Prosecutors believe the two mailed documents that would lead to his benefiting from his mother Linda Poole Hilton estate once she died.
Poole Hilton along with her husband, William Henry “Bubba” Hilton Jr. were found shot to death Aug. 2, 2006 at their Lakewood Plantation home.
State murder charges against Poole were dismissed on Dec. 27, 2006, according to the memorandum filed by Truslow.
Truslow went on to say in the document some of the government's evidence against his client can be discredited through cross examination by the defense counsel.
U.S. District Court Judge Thomas E. Rogers III said that the defense presents valid arguments in the memorandum.
However, after reviewing all of the evidence, there isn’t a change in circumstances to alter a previous ruling to detain Poole, Rogers wrote in the document.
