MYRTLE BEACH, S.C. (AP) - A North Carolina man who has been convicted twice of killing his lover's husband in South Carolina will get another chance at a new trial.

The Sun News of Myrtle Beach reported that arguments are scheduled Tuesday at the South Carolina Supreme Court for John Boyd Frazier of Winston-Salem, N.C.

Twenty-three-year-old William Brent Poole of Mocksville, N.C., was shot on June 9, 1998, while walking on the beach in Myrtle Beach with his wife, Kimberly.

Authorities say Kimberly Poole and Frazier conspired to kill William Poole.

Frazier was convicted of murder in 2000, but the state Supreme Court overturned his conviction and life sentence.

He was convicted in 2005 of murder, armed robbery and conspiracy and sentenced to 30 years in prison.

Kimberly Poole was sentenced to life in prison.
