After Marion City Council members voted for a city judge during the June meeting, the city's attorney informed them that the vote taken was void because it lacked a clear majority vote.
Five candidates were interviewed for the position, which came open after Judge Williams Seals was selected by legislators to fill a seat on the district court. They were Patricia Speth, Bobbie Hercules, Jesse Cartrette, Ulysses Sweeney and Levone Graves.
Nominated for judgeship were Speth, Graves and Sweeney. There were two council members who voted for Speth, two who voted for Swinney and three who voted for graves.
Attorney Kenneth Davis said with a council of seven members, at least four votes would be required to have a majory vote in the election. So, for lack of majority vote, the election was void.
A motion to place the election on the July agenda passed.
The city aministrator was to to alert everybody about the election and the five candidates are still being considered for the position
