Conway homeowners fear foreclosure

The Gauses say "nobody can swim" in the pool at Midtown Village.

Midtown Village in Conway was in the middle of construction when its developer, Portrait Homes, defaulted on its loans, halted sales and additonal construction last fall. Mark and Karen Gause, who live in the Midtown Village community, are afraid they may lose their home.

GlassRatner Management and Realty Advisors of Atlanta is now in charge of Midtown Village, located off Medlin Parkway in Conway.

The Gauses say they, and other families in the community, are not happy with maintenance of the neighborhood's property, and they want a new contractor to take over the project.

If a developer does not take over the project, the Gauses fear they may face foreclosure.

"You know, starting over like we've done has been a challenge and we've made it this far. And now, to have it all come to a point like this. It's a lot to bite off of," Frank Gause said.

The Gauses were excited about the possibility of meeting new people when they bought their townhome. But instead of meeting new people by stepping into the swimming pool, they have encountered mostly just mosquitoes, snakes, and frogs in the community's algae covered pool.

"We definitely can't come around here and enjoy to socialize because it's just too unsightly," Karen Gauses said.

The pool has not been the only issue of concern for the Gauses.

"We also have issues about the washing of the houses that's supposed to be done, the gutters, we don't get anyone to clean out our gutters cause there's some kind of discrepancy on that," Frank Gause said.

Next to their front lawn, pipes and knee high weeds cover an unfinished construction project. Portrait Homes began building a new town home in October. But, once the economy worsened in October, they stopped construction.

Pac Zachary, of GlassRatner, is the receiver of the property.

Zachary said, "Since the developer (Portrait Homes) deserted the projects, the money has to come from the home owner's association to pay for pool and property maintenance."

He also said that GlassRatner will not spend additional money to fix the pool and grounds.

Homeowners in Midtown village pay around $200 per month to their HOA to cover things like insurance and water bills.

The Gauses are afraid that they will not be able to pay additional fees and as a result, won't be able to afford their home and will ultimately lose the property.
