Myrtle Beach faces lawsuit over ordinances

The city of Myrtle Beach is facing another lawsuit over some of the 15 new ordinances passed September 23, 2008.

The suit was filed Friday in United States District Court in Florence, by Charleston-based attorney, Elizabeth P. Marlow.

The plaintiffs are Michael Shank, Highlander Marketing, Inc., Festival Promotions, LLC, and Myrtle Beach Harley-Davidson, LLC.

The suit claims the ordinances violate the plaintiffs’ rights under both the United States Constitution and the South Carolina State Constitution.

The suit also claims the plaintiffs will millions of dollars and be subject to criminal and civil prosecution, if the ordinances are not declared invalid.

Myrtle Beach spokesman Mark Kruea said the city has not yet been served with any lawsuits.
